Terms and Conditions

The « App-écho » Application and the « verdanova » platform are published by Alpes-éco Schweiz AG, a Swiss public limited company, Route de la Galaise 34, CH-1228 Plan-les-Ouates, registered in the Geneva Canton commercial register (IDE/UID: CHE-379.691.150).

01Purpose

The Applications allow monitoring, management, analysis and prevention of activities related to outdoor farming, natural ecosystems and Geo-Risk Zones. Use of the Application implies full acceptance of these Terms and Conditions (ToC).

02Access and Account Creation

Access to services is conditional upon creating a professional account. The User undertakes to provide accurate and up-to-date information and to maintain the confidentiality of their credentials. Any fraudulent use must be reported to Alpes-éco Schweiz AG.

04User Commitments

The User undertakes to use the Services in compliance with applicable laws. Any attempt to disrupt systems, identity theft or unauthorized commercial use of the Application is prohibited.

05Alpes-éco Schweiz AG Commitments

Alpes-éco Schweiz AG acts under an obligation of means to guarantee the accessibility and quality of the Services. It cannot be held responsible for indirect damages or in case of force majeure.

06Service Availability

Interruptions may occur for maintenance. Alpes-éco Schweiz AG will endeavor to limit their duration and impact. The User acknowledges the limitations related to the Internet and telecommunications networks.

07Suspension / Termination

Any abusive or non-compliant use may result in suspension or termination of access, after notification or direct finding of a violation.

08Force Majeure

Neither party may be held liable for a breach attributable to force majeure as recognized by Swiss case law.

09Personal Data, Location and Animal Data

Alpes-éco Schweiz AG processes personal data in compliance with the Federal Data Protection Act (FDPA) and GDPR.

Location

  • Service activation involves device location, never users.
  • No personal geolocation data is collected without the User's knowledge.
  • No data is resold to third parties.

Data from Devices

  • Data collected by connected devices may be used by Alpes-éco Schweiz AG for statistical purposes, product improvement, research and ethological analysis, in compliance with applicable legislation.
  • This data is pseudonymized and does not allow direct identification of users or animals without specific secure access.
  • No data commercialization is carried out without explicit consent.

10Cookies and local storage

The website and customer space set no advertising cookies or trackers and use no audience measurement tool. Only a session cookie, required to access the écho space, and the browser's local storage, which keeps the chosen language and the basket on the User's device, are used. These elements are strictly necessary to the service and do not require consent. Map display relies on third-party map providers, which receive the device's IP address for the sole purpose of serving base maps; notifications of the mobile Applications pass through a third-party notification service on the basis of a technical device identifier, without personal data.

11Artificial intelligence

Some functions of the Applications rely on artificial intelligence systems: the conversational assistant Heidi, the automatic classification of animal activity and predictive analyses. The User is informed that they are addressing an automated system when interacting with Heidi. These systems process data relating to animals and devices, never biometric or behavioural data of persons, and make no decision producing legal effects on the User: alerts and analyses are decision aids whose assessment and follow-up remain the User's responsibility. Requests addressed to Heidi may be processed by third-party language model providers; they contain no personal identification data. Alpes-éco Schweiz AG designs and operates these systems in accordance with Regulation (EU) 2024/1689 on artificial intelligence for Users in the European Union and with applicable Swiss law; they fall within the category of limited-risk systems subject to transparency obligations. The results produced may contain errors and replace neither the farmer's supervision nor the advice of a veterinarian.

12Intellectual Property

All content, trademarks, logos and tools of the Application are the exclusive property of Alpes-éco Schweiz AG. Any reproduction or use without authorization is prohibited.

13Contractual Documents

These ToC constitute the complete agreement between Alpes-éco Schweiz AG and the User. They may be supplemented by the General Terms and Conditions of Sale related to physical products.

14Assignment

Alpes-éco Schweiz AG may assign the ToC and their obligations to a third party without prior approval, particularly in case of merger or business transfer.

15No Waiver

Failure to apply a clause does not constitute waiver of the right to invoke it later.

16Severability

If a clause is deemed invalid, it will be replaced by a clause of equivalent effect, without affecting the validity of the rest of the ToC.

17Modifications

The ToC may be modified at any time. Any modification will result in user notification. Use of the Application after update constitutes acceptance.

18Applicable Law and Jurisdiction

The ToC are governed by Swiss law. In case of dispute, the parties will seek an amicable solution. Failing that, the courts of the Canton of Geneva shall have exclusive jurisdiction.
