General rental terms and conditions

The "Equipment Rental" service is provided by Alpes-éco Schweiz AG, referred to as the Lessor. The rental conditions form an integral part of the rental contract. By signing the rental contract, the contracting party, referred to as the Lessee, confirms having read and accepted these General Rental Terms.
Purpose
The Lessor temporarily rents to the Lessee the connected devices or other equipment described in the rental contract (the Equipment). The Equipment remains the property of the Lessor and the Lessee may not claim any ownership rights thereto.
The rented Equipment may be new or used, provided it is in good working order. Accessories (device mounts, collars, cables, etc.) form an integral part of the Equipment.
Equipment delivery
The Lessor makes the Equipment available to the Lessee in good working order and with operating instructions (digital format). The Equipment is sent by post or handed over in person on the delivery date specified in the contract.
The Lessee must inspect the Equipment upon receipt and submit any claims to the Lessor within 3 days, by email or WhatsApp (with supporting photos). Otherwise, the Lessee acknowledges having taken possession of the Equipment in good condition.
Rental duration and renewal
The rental duration is specified in the contract. It begins on the date the Equipment is made available and ends on the return date. An extension is only possible with the agreement of both parties. If the Lessee checked YES for automatic renewal, the contract will be renewed provided the invoice is paid on time. Either party may terminate automatic renewal with notice received at least two months before expiry.
Pricing and payment
Equipment rental rates are indicated on the invoice or purchase order. Payment is due upon signing the rental contract or on the date specified in the purchase order. Any payment delay may result in additional charges and/or immediate termination of the rental contract.
Equipment usage conditions
It is forbidden to use the Equipment to geolocate persons, even temporarily, or objects over which the Lessee does not have all necessary rights.
Installation of the mobile application and network coverage are the Lessee's responsibility. The Lessor cannot be held responsible for incompatibility with the smartphone operating system or for NB-IoT, LTE-M or LoRaWAN network coverage.
The Lessee undertakes to
- Use the Equipment with care and follow the operating instructions
- Use suitable collars and install devices in accordance with recommendations
- Ensure animal comfort at all times
The Lessee is prohibited from
- Unscrewing the device cover
- Drilling, sanding or marking the device serial number
- Dismantling or tampering with the electronic board
- Replacing or disconnecting the batteries
- Performing maintenance on the Equipment themselves or through an unauthorised third party
- Using the Equipment in a manner not compliant with applicable legislation
The Lessee shall return any defective Equipment at their own expense as soon as possible. The Lessor undertakes to ship replacement Equipment in working order within 48 hours (shipping time not included).
Early battery replacement due to misuse is the exclusive responsibility of the Lessee. Replacement due to normal wear is the Lessor's responsibility (except shipping costs).
The Lessor shall in no event be liable for direct, indirect or consequential damages arising from the use or inability to use the Equipment.
Serious and/or repeated non-compliance with usage conditions may result in immediate termination of the contract with the obligation to return the Equipment at the Lessee's expense and without right to reimbursement.
Equipment return
At the end of the rental period, the Lessee undertakes to return the Equipment to the Lessor in the same condition as on the date of availability, except for normal wear and tear.
Equipment installed on animals being subject to a hostile environment, the Lessor acknowledges increased wear on casings and mounts. Except in cases of obvious abuse or negligence, no repair costs will be charged for this Equipment.
In case of loss, theft or damage due to inappropriate use, the Lessee must notify the Lessor without delay. Repair or replacement costs will be fully charged to the Lessee.
The Equipment must be shipped in its original packaging by post to the Lessor's address. Postal and insurance costs are the Lessee's responsibility. Non-return within 10 days of contract expiry may result in criminal prosecution by the Lessor.
Personal data protection
The Lessee acknowledges that use of the Equipment and application involves the collection and processing of personal data. The Lessor undertakes to process this data in accordance with the FDPA and to use it only in the context of service provision.
Personal data is retained for as long as the user is registered on the application, plus the legal limitation period related to the contract and accounting.
Animal geolocation data will be destroyed or anonymised upon Equipment return. However, it may be used for research and development purposes to improve products. No user geolocation data is collected.
The Lessee has rights of access, erasure, restriction or objection to the processing of their data, in cases defined by the FDPA. They may exercise their rights at any time by emailing : contact@alpes-eco.com
The Lessee may report to the Federal Data Protection and Information Commissioner (FDPIC) any processing of their personal data that they consider contrary to the FDPA.
Insurance
The Lessee is required to take out insurance covering the risks related to the rental of the Equipment, including damage, theft and civil liability.
Applicable law and jurisdiction
The contract and these General Rental Terms are governed by Swiss law. Any dispute will be subject to the exclusive jurisdiction of the competent court at the Lessor's registered office. Prior to any legal action, the parties undertake to resolve the dispute amicably through conciliation.
